We at Target Marketing List Corporation respect your right to privacy. Customer and prospect information is never sold or transferred to any other individual or organization. We use the information strictly for our own internal and demographic purposes.
If at any time you wish to be removed from our mailing list, simply go to our contact page, enter the required information, and type “Opt Out” in the space provided.
Warranties
Target Marketing List Corporation (TMLC) warrants to Client that TMLC Services will materially conform to the corresponding TMLC Job Instructions and that TMLC has the right to provide to Client the uses authorized by this document provided as a part of the TMLC Services. TMLC further warrants that it will make reasonable commercial efforts to ensure that the TMLC Data delivered hereunder to Client, and information contained therein, will be as complete and accurate as it can be in view of TMLC’s customary method of compilation or acquisition of such data and the nature and accuracy of TMLC’s sources for such data. HOWEVER, TMLC DOES NOT GUARANTEE THE ACCURACY OR RELIABILITY OF SUCH DATA AND IS NOT RESPONSIBLE FOR THE RESULTS OR CONSEQUENCES THAT COME FROM THE USE OF SUCH DATA.
Client understands and acknowledges that certain states may require the purchase of lists which provide a directory of consumers who object to receiving certain outbound telephone solicitations (“Do-Not-Call lists”). TMLC agrees to provide Client with services that will purge consumers on the various Do-Not-Call lists from the calling lists provided by TMLC to Client. Client agrees to purchase such Do-Not-Call lists from the appropriate states, and Client will indemnify and hold TMLC harmless from any third party claims arising from calls placed to consumers who are on the various Do-Not-Call lists. TMLC disclaims all responsibility for ensuring that Client complies with the laws establishing the Do-Not-Call lists.
THE FOREGOING WARRANTIES ARE THE ONLY WARRANTIES TMLC HAS GIVEN CLIENT WITH RESPECT TO ITS SERVICES. SUCH WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
IN NO EVENT SHALL TMLC BE LIABLE TO CLIENT OR ANY THIRD PARTY FOR INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES; FOR LOST PROFITS, SAVINGS, OR REVENUES OF ANY KIND; FOR LOST DATA OR DOWNTIME; OR FOR PRINTING COSTS OR POSTAL CHARGES, REGARDLESS OF WHETHER OR NOT TMLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
